Area of applicability: geographical Europe including Turkey and the countries within the area of the former Soviet Union including Lithuania, Latvia and Estonia.

As a general rule, the insurance does not cover any liability claims from activities

  1. performed by law firms or offices established or maintained in other countries;
  2. in connection with the rendering of advice and involvement in relation to non-European law;
  3. performed by a German lawyer (Rechtsanwalt) before non-European courts.

Pursuant to the Federal Lawyer's Act (Bundesrechtsanwaltsordnung- BRAO), German lawyers are obliged to set up a professional indemnity insurance with a minimum cover of € 250,000. Details can be found under section 51 of the Federal Lawyer's Act.

In addition to local compulsory insurance cover in Germany, Ashurst maintains a global professional indemnity insurance program. The firm's professional indemnity insurance program provides cover which Ashurst regards as appropriate for a firm such as ours. The firm's professional indemnity insurance program is confidential. Nevertheless Ashurst understands that its clients must be reasonably satisfied as to the appropriateness of the level of cover effected by the firm. While the firm has strict protocols about disclosures of its professional indemnity coverage, Ashurst will deal in good faith with you on this issue.
