Ashurst advised affiliates of finance investor Cerberus on the acquisition and the financing of eight shopping centres. The properties are part of a transaction known in the market as 'Project Shift'.
Ashurst advised with real estate, finance and competition lawyers from Frankfurt, Munich and London. The team was led by Frankfurt-based partners Marc Bohne (real estate) and Dr Stephan Kock (finance) who advised together with partner Peter Junghänel, senior associate Dr Hendrik Theismann and associate Adnan Manzoor (all real estate, Frankfurt). The counsel Petra Fendt and Tobias von Gostomski (both finance, Frankfurt) advised on the financing. Senior associate Maria Held from the Munich office covered antitrust aspects while senior associate Francoise Haralamb from the Luxembourg desk in London covered Luxembourg law.
Ashurst regularly advises the Cerberus group in connection with real estate transactions and their financing in Germany. In 2011, the firm advised the group on the acquisition of a 45 retail properties-strong portfolio from the family offices of the majority shareholders of Metro group, the Beisheim, Haniel and Schmidt-Ruthenbeck families. Two years later, Ashurst supported affiliates of Cerberus on the acquisition of ten shopping centres (Monsoon portfolio) out of an insolvency.
