- Trade secrets and employees: Effective contract terms, and the practical steps that can be taken if a breach of confidentiality and trade secrets obligations is suspected
- Breach of confidence in the English courts: what types of information can be protected, and how to define your claim: Trade secrets can take many forms, from recipes to rolodexes, source code to secret sauces. However, it can be hard to define exactly what the trade secret is, or show that it was confidential at the relevant time. We will look at examples of common mistakes made by claimants and defendants in breach of confidence claims.
- Evidence and forensics: Evidence of misappropriation is crucial to the success of trade secrets claims. Computer forensics have become an essential part of most claims, and it is hard for defendants to avoid leaving 'digital footprints' when accessing, taking or using information and data without authorisation.
