We advise our clients on all regulatory matters and how they should respond to and investigate them; including in relation to financial crime, regulatory enforcement, systems and controls, complaints handling, misconduct and structured products. Our depth of understanding of financial regulators and regulations allows us to provide incisive advice to our clients in order to react and respond to regulatory investigations and proceedings in the most impactful way.

Our experience includes advising:

  • ANZ on the successful defence of the exception fees class action brought on behalf of customers to recover a range of fees charged by ANZ on consumer and business transaction accounts and credit cards. The cases involved allegations of penalty, unconscionability and unfair contract terms;
  • Cattles and Welcome Financial Services on a £1.6bn claim for audit negligence, one of the largest ever cases in the UK High Court;
  • Credit Suisse in the defence of mis-selling claim by an investor against the bank in relation to accumulator transactions;
  • A leading US bank in investigations in London, Hong Kong, Tokyo and Sydney into alleged manipulations of foreign exchange markets, including advising extensively on remedial measures implemented as a result of the investigations; and
  • A syndicate of seven banks in relation to global proceedings in Singapore, India and Dubai following alleged fraudulent activity/conspiracy and a repayment default under English law governed trade finance arrangements.
