James Marshall is a partner in the restructuring and insolvency group in Sydney.

James' practice includes: acting for lenders and creditors to help manage their credit risk; advising parties who are active in the secondary debt markets; the financial restructuring of distressed companies; and distressed mergers and acquisitions.

James acts for a number of lending syndicates to distressed companies and also advises in respect of formal insolvency administrations.  He is currently advising the liquidators of Babcock & Brown Limited, Allco HIT Limited and Lehman Brothers Australia. He has extensive experience with creditors' schemes of arrangement having advised parties involved in the Opes Prime and Lift Capital schemes of arrangement.

His recent restructuring work includes designing and executing loan to own strategies for the senior lenders of Colorado Group and Godfreys Group.

James acts for a number of leading hedge funds and investment banks and has had significant roles in the Alinta Energy debt/equity swap scheme of arrangement and in acting for a bidding consortium in relation to the assets of the Centro Properties Group.  He is active in the growing secondary debt market having transacted both single credit and portfolio trades on behalf of buyers and sellers in this market. 

He has also recently been involved in advising parties in relation to significant distressed property and infrastructure groups including: Redbank Energy; Centro Property Group; Alinta Energy; Rivercity Motorways and Lane Cove Tunnel; Reliance Rail; Cross City Tunnel and Redcape/Hedley Group.

James has extensive cross-border experience and has recently completed the first successful application under the UNCITRAL model cross border law for in-bound recognition in Australia by the foreign representative of Samsun Corporation, a Korean shipping conglomerate which is in formal rehabilitation proceedings in Korea.
